Nevada ACLU sues over Trump admin’s new mandatory detention policy

Filed Tuesday, the federal lawsuit challenges a new policy implemented by Immigration and Customs Enforcement (ICE) earlier this year.

The American Civil Liberties Union of Nevada and the UNLV Immigration Clinic have filed a federal class action lawsuit challenging the new mandatory detention policy implemented under the Trump administration.

Filed Tuesday in the District Court of Nevada, the case challenges a new policy implemented by Immigration and Customs Enforcement (ICE) earlier this year requiring anyone facing deportation to be held in mandatory detention with nearly no opportunity for a bond hearing while their immigration case moves forward, even if they don’t have a criminal record or have lived in the U.S. for decades.

In July, ICE reversed a longstanding agency policy allowing immigration judges to determine if detention is necessary to protect the public or ensure people attend future immigration proceedings. More than a hundred federal judges have ruled against the policy change since its implementation, and similar class action suits have been filed in other states, including Massachusetts.

The suit names Department of Homeland Secretary Secretary Kristi Noem and U.S. Attorney General Pam Bondi as defendants. Other listed defendants include John Mattos, warden of the Nevada Southern Detention Center.

The lawsuit was filed on behalf of two immigrants, Victor Ramirez and Edgar Alcantar, who were denied a bond hearing. The suit contends that the policy has resulted in possibly hundreds of individuals in Nevada being denied bond hearings.
