Advocates say many courts not adhering to Supreme Court decision that restricted cash bail

The two Clark County public defenders who argued the case — Nancy Lemke and Christy Craig — told lawmakers during a Wednesday meeting of an interim committee studying pretrial detention that multiple changes in law, and potentially enhanced court system funding, were needed to see the state fully comply with the court’s decision and new framework for assessing cash bail.

Nevada Supreme Court orders significant limits on cash bail

In a 6-1 ruling published Thursday, justices authored a majority opinion that created a new three-tiered process for lower-court judges and prosecutors to follow before requiring a person to pay cash bail in order to be released before trial. It also requires judges to take into consideration a person’s finances before assessing any cash bail as a condition of release.

Lawsuit before state Supreme Court seeks to curtail use of cash bail statewide

An otherwise unremarkable criminal case against 58-year-old Jose Valdez-Jimenez, accused of stealing thousands of dollars of merchandise from multiple Victoria’s Secret stores in Las Vegas last year, could be the catalyst for a radical shift in Nevada’s system of allowing judges to require cash bail be posted before a defendant in a criminal case is released prior to the start of a trial.
